This Is Not a Construction Mechanics Lien

Same word, completely different statute. A construction mechanics lien is a claim recorded against real property with a county recorder for labor or materials that improved a building. A vehicle or garagekeeper's lien is possessory personal-property security under an entirely separate chapter — Cal. Civ. Code §3068, Tex. Prop. Code §70.001 and §70.003(c), Fla. Stat. §713.585 and §713.78, N.Y. Lien Law §184, O.C.G.A. §40-11-19. Nothing is recorded and no county recorder is involved. If your unpaid work was on a building, you need the mechanics lien form instead.

Two things carry this lien: the vehicle staying in your lot, and a notice chain you can prove. Get either wrong and the strongest claim in your business quietly stops being one.

Release the Car and in Most States the Lien Dies

Possession is the security. Handing the vehicle back on a promise, a partial payment or an uncleared check usually extinguishes the lien and leaves you with an ordinary unsecured debt and no leverage. Hold the vehicle until the payment has actually cleared.

Every Lienholder, Not Just the Owner

Every state's process requires notice to all lienholders of record, and that chain gets audited when the state is asked to title the vehicle to your buyer — New York works the full MV-901C packet before it issues one. Skipping the finance company is not a shortcut; it can leave a garage liable to the bank in conversion. The form builds a recipient block per lienholder rather than a single owner letter.

Late Notice Amputates Your Revenue

The penalties are financial, not procedural. In New York storage counts only from the day the notice was actually mailed — every day before that is unrecoverable (N.Y. Lien Law §184). In Florida a bad-faith notice failure forfeits all storage charges (Fla. Stat. §713.585(13)). Your License Can Be the Whole Lien

In New York a repair shop required to register under Vehicle and Traffic Law Art. 12-A but not registered gets no lien at all, and the DMV rejects the title application outright (N.Y. Lien Law §184(1)). In Texas a storage lot without a Vehicle Storage Facility license (Tex. Occ. Code ch. 2303) has no lien on the storage track. The form checks the precondition for your state and business type before it builds anything.

Charge Your Posted Rate, Nothing More

Caps and posted-rate rules are enforced hard. In California, claiming storage above your posted rate voids the lien entirely, and what you can recover against the legal owner or lienholder is separately capped (Cal. Civ. Code §3068). Georgia caps recoverable storage at days-stored-plus-25 (O.C.G.A. §40-11-19(d)(2)). Virginia caps a financed vehicle at $500 storage and $1,000 repair (Va. Code §§46.2-644.01/.02). Illinois caps the entire lien at $2,000 under the Labor and Storage Lien (Small Amount) Act (770 ILCS 50) — above that there is no self-run sale at all. Padding the total is how liens die and counterclaims are born.


The Path to Sale

The sale is where states diverge most, and where an honest operator most often does something unlawful by accident. Three different authorities can stand between you and the auction — and in one state there is no lien sale at all.

You Run It — Self-Executing States

Texas allows a public sale no earlier than day 31 after the notice is filed with the county tax assessor-collector (Tex. Prop. Code §70.006(f)), and that filing within 30 days of charges accruing is what perfects the lien against third parties (§70.006(a)). Florida's tow and storage track runs 35 to 57 days out depending on the vehicle's model year (Fla. Stat. §713.78), with repairs on a separate track no earlier than 60 days after completion (§713.585).

The DMV Runs It — Agency-Gated States

California splits at $4,000: at or under, a streamlined DMV sale application (Cal. Civ. Code §3072); above it, full DMV Lien Sale Authorization (§3071). Ohio titles a vehicle under $3,500 straight to the shop by affidavit through the Clerk of Courts (R.C. §4505.101). Virginia runs a DMV title search first and adds a court petition above its $12,500 and $25,000 tiers (Va. Code §46.2-644.03). North Carolina has the DMV mail the owner's hearing notice for you (N.C. G.S. §44A-4).

A Judge Runs It — and a Self-Run Sale Is Unlawful

Georgia requires a magistrate-court order before any auction (O.C.G.A. §40-11-19.1). Washington enforces repair liens judicially under RCW ch. 60.10 after a county auditor filing within 90 days of completing the work, with tow and storage under RCW 46.55. In these states no notice-of-sale process exists for you to run yourself — only the court can order the sale, and sending sale language anyway is exactly the mistake the roadmap exists to prevent.

The Official Form Is the Process

Where a state mandates its own form, your own paper fails at the title counter no matter how well drafted it is. New York runs on the MV-901A notice and the MV-901C packet, with the DMV auditing the entire notice chain before it issues the buyer's title. Georgia uses the magistrate-council letter. The form renders the official-form path in those states instead of a custom notice, plus the filing instructions that go with it.

One State Has No Lien Sale at All

Hawaii does not recognize a storage lien on vehicles (HRS §507-18). There is no lien-sale path to run: the remedy is a money judgment in district or small claims court. The form generates the demand letter and routes the roadmap to court rather than producing sale language with no legal basis behind it.
