Paraquat MDL November 2025 Update

The Paraquat multidistrict litigation (MDL) has continued to grow over the past several months. These are some of the most important updates:

The Stay Continues

In May of 2025, the judge issued a 30-day stay, or a pause on all discovery deadlines. A stay temporarily halts litigation so that the two sides can negotiate a settlement. Negotiating lawsuit settlements in MDLs can be extremely difficult, and the stay has been repeatedly extended to allow for more time.

On October 2, 2025, the judge extended the stay once again. It will now last until January 5, 2026. So will the new year lead to a settlement? That remains to be seen.

New Lawsuits Keep Coming

The stay pauses case-specific discovery, but it doesn’t prevent more plaintiffs from filing lawsuits. As of October 1, 2025, there are a total of 6,445 lawsuits in the Paraquat MDL.

However, it’s important to note that even though the total case count is growing, weaker claims or those without evidence are also being dismissed. For those with strong, evidence-backed claims, weeding out unsubstantiated claims can increase the chances of a fair settlement.

A New York Times Article Reveals Unsettling Truths

In many lawsuits involving dangerous drugs, it often eventually comes to light that the manufacturer knew about the risks and suppressed information to protect profits. This appears to be the case with Paraquat as well.

A New York Times article released in September 2025 revealed evidence that manufacturers have been aware of Paraquat’s detrimental effects on the nervous system for years. Those manufacturers deliberately downplayed the risks while continuing to promote the herbicide.

Importantly, the article pointed out that Paraquat and other herbicides aren’t just responsible for a small portion of cases. Many scientists have come to believe that Parkinson’s disease is largely caused by human-made environmental toxins.

Past Paraquat Lawsuit Updates

Late in January 2025, a Wisconsin man filed a lawsuit alleging his prolonged exposure to Paraquat caused his Parkinson’s disease. The lawsuit is filed as part of the Paraquat MDL. 

The plaintiff states that his exposure to Paraquat occurred during his work as an agronomist from 1980 to 1985. The lawsuit alleges that Paraquat is unreasonably dangerous and defectively designed. It also asserts that the manufacturer failed to warn users of Paraquat’s neurotoxic risks, a pattern echoed in ultra-processed food lawsuits, where companies are accused of concealing links to conditions like diabetes and liver disease.

Another new MDL Paraquat lawsuit was filed in Florida at the end of January. A Florida man alleges that Paraquat exposure caused his Parkinson’s disease, which was diagnosed in 2020. The complaint details that the plaintiff was regularly exposed to Paraquat while maintaining a property from 2013-2019.

The plaintiff and his spouse, who has joined the lawsuit, are pursuing compensation for healthcare expenses, pain and suffering, loss of companionship, and other damages.

Over 50 Cases To Be Dismissed from Paraquat MDL

A combined 57 cases face dismissal from the Paraquat MDL. Ten cases were dropped in early January, with more dismissals expected in due course. The reason for the potential dismissals is the failure of plaintiffs to submit the required Plaintiff Assessment Questionnaires (PAQ), which are necessary for the discovery process.

MDL Status Conference Held in St. Louis

On January 31, 2025, a status conference took place in the East St. Louis Courthouse, presided over by Chief Judge Rosenstengel and attended by plaintiff and defense attorneys. Updates were provided on state court cases, and the schedule for the initial phase of trial preparation was discussed. The judge emphasized the importance of plaintiff attorneys maintaining communication with their clients. The next status conference regarding the Paraquat MDL is set for April 2025.

California Department of Pesticides Releases New Studies

According to Assembly Bill 1963, signed by Gov. Gavin Newsom in 2024, the California Department of Pesticide Regulation (DPR) must complete a reevaluation of the pesticide paraquat by January 2029. On December 30, 2024, the DPR released two preliminary scientific reports on human health effects and the ecotoxicology of Paraquat.

While the DPR did not find a causal association between Paraquat exposure and Parkinson’s disease, the studies identified an association between birth defects and thyroid impacts and exposure to Paraquat. However, a study published by the National Library of Medicine earlier in 2024 did establish a link between exposure to Paraquat and Parkinson’s disease.

Status of the Paraquat Bellwether Trial

The first Paraquat bellwether trial was scheduled for early 2025 but is now expected to take place sometime in late 2025. The delay occurred because the MDL judge dismissed four cases due to the expert witness testimony being insufficient under the law.

There is speculation that a global settlement for the Paraquat lawsuits may occur within the next six months, although this is not guaranteed.
