Summary

  • Plaintiffs are currently fighting Bayer in a multi-party lawsuit
  • Eligibility for the Bayer case is limited to victims with certain cancers
  • Ineligible plaintiffs can still sue Bayer in a separate lawsuit

Roundup allegedly causes serious health problems with short- and long-term exposure. The active ingredient, glyphosate, may be a carcinogen and an endocrine disruptor. As a result, people exposed to the herbicide can develop a range of issues, including certain types of cancer.

Qualifying Diagnoses for a Roundup Lawsuit

To understand the qualifications for the Roundup lawsuit, you must first understand its current status. Plaintiffs have been filing lawsuits against Monsanto and its current owner, Bayer, for over a decade. In 2016, the U.S. Judicial Panel on Multidistrict Litigation (MDL) transferred all the cases filed across the country to a single court.

By appointing a single judge to oversee all the cases, the plaintiffs could cooperate on discovery and motions. To ensure these synergies were realized, the panel set certain eligibility requirements based on similar facts and legal claims.

One of the requirements is an eligible diagnosis. By requiring plaintiffs to have similar diagnoses, the court can focus on certain facts, experts and legal principles.

The panel defined what cancers are included in the Roundup lawsuit. According to the transfer order, the MDL covers non-Hodgkin lymphoma. Since then, the court has added certain forms of leukemia. In non-medical terms, the qualifying diagnoses are cancers of the lymph system or blood cells.

What Level of Exposure Proves Eligibility?

A person with non-Hodgkin lymphoma cannot meet the Roundup lawsuit eligibility requirements by simply alleging the right form of cancer. The plaintiff must have proof of at least some Roundup exposure.

What Medical and Scientific Proof Is Required?

There is no specific evidence required to file a lawsuit as part of the MDL. However, the following evidence could help to support your claim and establish your eligibility:

  • Medical records with a qualifying diagnosis
  • Work records showing exposure to Roundup
  • Scientific reports alleging a link between them

The exact proof required will vary based on the case.

How the Statute of Limitations Affects Eligibility

In most states, the discovery rule applies to toxic exposure claims. Specifically, the statute of limitations starts to run when the plaintiff discovers or reasonably should have discovered the injury. For example, in Wisconsin, the statute of limitations begins running when the cause of action accrues. The courts have interpreted this to mean that the plaintiff must know that they have been injured.

Role of Geographic Location and Product Use

The concentration and nature of application do not determine eligibility. These are issues for a judge or jury to review to determine whether the plaintiff has proven their case.

When Exposure Doesn’t Qualify

Plaintiffs without qualifying diagnoses can still sue Bayer. However, they cannot join the MDL.
