What Is the Facebook Social Media Addiction Lawsuit?

The Facebook lawsuits have been transferred to a multidistrict litigation (MDL) in northern California. These lawsuits include Facebook, Instagram, TikTok, YouTube, and other video-sharing apps. They allege that these apps were designed to maximize engagement by using elements that eliminate any effort by viewers.

What Are the Allegations Against Facebook?

The lawsuits allege that the following features in the Facebook app promote compulsive viewing:

  • Endless scrolling that provides an unlimited, tailored playlist of videos
  • Autoplay, which automatically starts the next video
  • Push notifications that alert the user to new videos when they are outside the app

The lawsuits allege that Facebook is liable for users’ addictive behaviors under two theories, which are negligence and product liability.

First, they allege that Facebook is negligent in designing and releasing a product that poses an unreasonable risk of addiction, particularly by children.

Under this theory, the company had a duty to exercise reasonable care in protecting the health and safety of its customers. The company violated this duty because it knew or should have known that users could become addicted to its video app.

Second, the plaintiffs assert that Facebook’s app was defective because it promoted compulsive use. One way the law often distinguishes between product defects and clever designs is by balancing the costs and benefits. In this case, the plaintiffs allege that the harm caused by the three features far outweighs any user benefits.

Defenses Presented by Facebook

To contest these allegations, the company has argued that there are many factors that can influence someone’s mental health, including any compulsive behavior patterns. Without extensive medical documentation and a more universally accepted diagnosis for a condition of “social media addiction,” the company disputes that it’s responsible for users who misuse the platform.

The company also highlights various tools that are included to protect users, including settings for limits on screen time and parental controls, which can help users and their families to regulate their own use of the platform.

Has Facebook Reached Any Settlements?

The company has not entered into any Facebook addiction lawsuit settlements. Moreover, none of the lawsuits against Facebook has reached trial.

However, the MDL covering the video-sharing addiction cases has reached the trial phase. The first trial occurred in January, but it did not include Facebook. Instead, YouTube and Facebook’s sister app, Instagram, were found liable for $3 million in economic damages and pain and suffering to a single plaintiff.

How Much Are Facebook Settlement Payouts Worth?

Facebook might view the $3 million verdict as an incentive to settle the cases against it. If it does, it may create tiered Facebook addiction lawsuit settlements.

Plaintiffs would submit evidence of their losses. Those with serious injuries, such as suicidal thoughts or self-harm, would receive larger settlements than those who had depression or anxiety but did not suffer any physical harm.

Who Qualifies to File a Facebook Settlement Claim?

The social media addiction lawsuits are focused on harm to children. As such, plaintiffs must show they used Facebook for three or more hours per day while they were between eight and 18. They must also have records proving they suffered mental health injuries due to their Facebook use.
