What Is the Instagram Addiction Lawsuit?

Instagram lawsuits assert that the company is liable for users’ mental health issues for two reasons. First, the plaintiffs assert that Instagram’s app includes a design defect that causes addictive behaviors. The judge has agreed that those product liability claims can proceed to trial.

Second, the plaintiffs claim that Instagram was negligent in designing and releasing its app features. In this case, users allege that negligence occurred when the company built an app designed for maximum engagement without taking reasonable steps to limit its harm.

For example, the plaintiffs allege that these features are available to anyone, including children.

What Are the Allegations Against Instagram?

The lawsuits name these features as unreasonably dangerous:

  • Push notifications
  • Autoplay
  • Infinite scrolling

These features remove the friction of finding and watching videos. Instead, push notifications alert users to new videos, even if they are not using the app.

Autoplay automatically starts new videos without any effort on the user’s part. Infinite scrolling creates a playlist of videos specifically selected to engage the user based on past viewing.

The lawsuits allege that these features are especially harmful to children. Children are more vulnerable to compulsive behaviors because they are typically less restrained. As a result, the plaintiffs accuse Instagram of targeting children by enabling these features without any age verification.

Potential Defenses to Allegations in the Instagram Addiction Lawsuits

As the company seeks to defend itself against these allegations, it’s likely to note that there isn’t currently a standardized diagnosis or definition of “social media addiction.” The company may also argue that the user’s own mental health history and surrounding environmental factors make it harder to claim that the app was the primary cause of any compulsive behaviors or usage patterns.

In its defense, the company may also cite tools built into the platform that are designed to allow users to set screen time limits or parental controls for minor users.

Has Instagram Paid Any Settlements?

The company has not paid any Instagram addiction lawsuit settlements as of May 2026. However, it was hit with a large verdict in January, possibly incentivizing the company to start settlement negotiations.

Specifically, thousands of lawsuits against Instagram and other video-sharing platforms were consolidated into a social media addiction multidistrict litigation (MDL). The MDL has reached the bellwether trial stage, where representative cases go before a jury.

In January, Instagram and YouTube were found liable for $3 million in damages to a single plaintiff.

How Much Could an Instagram Settlement Pay Out?

Instagram is unlikely to settle a case for $3 million. Juries are often generous when rendering verdicts, so any negotiated Instagram addiction lawsuit settlements will probably be more modest. However, they can still cover a plaintiff’s losses, including medical and therapy expenses, lost income and pain and suffering.

Who Is Eligible to File an Instagram Settlement Claim?

The Instagram MDL is limited to children and young adults whose mental health has suffered due to their use of Instagram. Plaintiffs must show that they used Instagram for at least three hours per day while they were between the ages of eight and 18.

They must also have medical records showing depression, anxiety, self-harm, body dysmorphia or suicidal thoughts as a result.
