The negligence alleged in the case was that the social media platforms knew or should have known that children use their platforms compulsively. Moreover, the plaintiff alleged that the companies deliberately designed features that enticed and encouraged compulsive use, including these:
- Infinite scrolling
- Autoplaying videos
- Recommending additional videos based on past consumption
Scientific studies support the connection between compulsive social media use and depression, anxiety and stress. Thus, the plaintiff alleged, and the jury found, that Meta and YouTube command a chain of events that starts with features designed to “hook” children and ends with foreseeable adverse mental effects on those children.
Importantly, the California jury did not determine whether social media platforms are liable under product liability law. States such as New York and California have passed laws requiring platform operators to display warning labels about their addictive features.
According to the California jury’s findings, companies that comply with the law by displaying warnings might escape product liability for warning defects, but may still be liable for negligence.
This case produced the first verdict against social media companies by a user. While the amount awarded gives some guidance to future plaintiffs, it does not necessarily guarantee similar awards for everyone harmed by social media. Instead, additional verdicts and settlements will be needed to accurately gauge the range of compensation that other victims might expect.
