What Is the TikTok Addiction Lawsuit?

The TikTok addiction lawsuits rest on two legal theories. First, companies are strictly liable for the injuries caused by their defective products. Strict liability means that the victims do not need to prove that TikTok intentionally or negligently harmed them. Instead, they only need to prove the existence of the defect.

Second, businesses are liable for injuries caused by company negligence. To prove this claim, plaintiffs must prove the following elements of negligence:

  • Duty of care to the customer
  • Breach of that duty
  • Losses suffered by the product user
  • Causal link between the breach and the losses

In the TikTok cases, the alleged losses include negative mental health effects, such as depression, anxiety, body dysmorphia and suicidal thoughts.

Defenses to the TikTok Addiction Lawsuit

There are several legal theories that TikTok has used to defend itself against allegations. The company points to its implementation of safety features like parental controls and limits on screen time, arguing that they are not responsible for the ways that individual users opt to interact with the platform.

Because there isn’t a specific clinical diagnosis associated with social media addiction, the company also argues that a legal injury can’t be proven, especially when other mental health factors outside of the app could be contributing factors to their choices.

All of the social media addiction lawsuits filed in federal court were transferred to a single district in a procedure called multidistrict litigation (MDL). There are no public TikTok addiction lawsuit settlements or verdicts to estimate the value of the remaining cases. However, those with minor depression or anxiety will likely receive smaller settlements.
